A stark reality in today's business world is that an ever-increasing number of debtors readily seek shelter under the Bankruptcy Code. However, the entry of a debtor into the bankruptcy forum does not halt Hemar, Rousso & Heald, LLP's pursuit on behalf of our clients. If the debt is of a secured nature, we may then proceed with an appropriate motion, be it for relief from stay or compelling acceptance or rejection of an unexpired executory contract. Should the debt be unsecured, aggressive and effective representation on the unsecured creditors committee may make the difference between minimal and significant repayment to our client. When appropriate, the firm will aggressively pursue the debtor into Bankruptcy Court, seeking to have the obligation held non-dischargeable through a formal adversary action.
