Once in litigation, our firm routinely utilizes pre-judgment remedies to gain leverage over the defendant-debtor. Applications for provisional remedies, such as writs of attachment and/or possession, or motions for the appointment of a receiver, are often prepared, filed and served simultaneously with the Summons and Complaint. The commercial debtor soon finds itself facing some immediate consequences of its recent delinquency, with a court hearing date set only days away; many suddenly "find the time" to respond to previously-ignored demands for resolution.
